ArrHub Website Terms of Use

1. Parties and acceptance

1.1 These terms govern the use of arrhub.com and of every other ArrHub site that links to them (the "Site"). The Site is published by Dalimer Outsourcing Inc., doing business as ArrHub, 83 West St-Paul Street, Montreal, Quebec H2Y 1Z1, Canada (NEQ 1176062009) ("ArrHub").

1.2 By using the Site, you accept these terms. If you do not accept them, do not use the Site.

1.3 A subscription to ArrHub Alerts is governed by the ArrHub Subscriber Terms at arrhub.com/legal/terms. If these terms and the Subscriber Terms conflict on a matter concerning a subscription, the Subscriber Terms prevail.

1.4 Language. The French version of these terms is presented first. In the event of any conflict or discrepancy, the French version prevails if you are located in Quebec, Canada; otherwise, the English version prevails.

2. Definitions

• Archive: issues after their release date, and documents published on the Site.
• Content: the issues, documents, tables, charts, videos, data and text published on the Site, including ArrHub's selection, arrangement and verification of Records.
• Records: entries in public registers, such as FDA and Health Canada databases, that ArrHub transcribes and links.

3. What the Site is, and what it is not

3.1 The Site reports Records as they stood on the dates stated, verified against the source register under the method published at arrhub.com/method. Registers can contain errors and can change after those dates.

3.2 ArrHub does not assess patent scope, validity or infringement, does not predict regulatory or commercial outcomes for any named company or pending application, and does not provide regulatory, legal, medical or investment advice. Nothing on the Site is intended for clinical use or for decisions about a patient's care.

3.3 Verify any Record against its source before relying on it. Each Record links to its source.

3.4 ArrHub publishes every correction at arrhub.com/corrections, with its date and what changed. To report an error, use arrhub.com/contact.

4. What you may do with the Content

4.1 Anyone may read and forward the Archive, subject to the notices it carries.

4.2 You may link to any page of the Site, and you may quote reasonable extracts of the Content with the source line retained and the attribution "Source: ArrHub", together with a link to the page quoted where the medium allows.

4.3 Search engines and answer engines may index the Site and display extracts with a link to the page, in accordance with the Site's robots.txt file.

4.4 Without ArrHub's written permission, you may not:

• extract the Content systematically, by scraping or otherwise, or copy a substantial part of it;
• use the Content to train or build a machine-learning model;
• republish, resell or redistribute the Content, or use it to build a product or service that competes with ArrHub;
• frame the Site, or present the Content in a way that suggests it comes from someone else or that ArrHub endorses you;
• remove or alter source lines, dates or notices;
• access subscriber-only content without a subscription, or share login credentials.

5. Ownership

5.1 The Content is made available by ArrHub and its licensors under licence. All rights not expressly granted in these terms are reserved.

5.2 The Records themselves are public. The Content's selection, arrangement, verification, text, tables, charts and videos are protected.

5.3 The ArrHub name and marks may not be used in a way that suggests that ArrHub is affiliated with, or endorses, a product, service or organisation.

6. What you send us

6.1 When you write to ArrHub, through the contact form or by email, do not send confidential information, or information about another person that you are not entitled to share.

6.2 ArrHub may use suggestions, coverage requests and error reports without restriction or payment. When a report leads to a correction, ArrHub publishes the correction without naming you, unless you agree.

6.3 ArrHub handles the personal information in your message under its privacy policy.

7. Acceptable use

7.1 You may not:

• attempt to access parts of the Site or data not intended for you;
• test, probe or circumvent security or authentication measures;
• disrupt or overload the Site, including through automated access contrary to the robots.txt file or at a rate that impairs its operation;
• introduce malicious code;
• impersonate ArrHub or any other person;
• use the Site for an unlawful purpose.

7.2 ArrHub may suspend or block any access that breaches this section.

8. Links to other sites

8.1 The Site links to primary sources and to other sites that ArrHub does not control. A link shows where a Record comes from; it does not mean that ArrHub endorses the site or is responsible for its content, availability or privacy practices.

9. Availability and changes to the Site

9.1 ArrHub may change, suspend or withdraw any part of the Site without notice. Its commitments to subscribers are set out in the Subscriber Terms.

10. Disclaimer

10.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND THE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". ARRHUB DOES NOT WARRANT THAT ANY REGISTER, RECORD OR CONTENT IS ACCURATE, COMPLETE OR CURRENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

11.1 TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ARRHUB OR ITS LICENSORS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR OPPORTUNITY, ARISING FROM THE USE OF, OR INABILITY TO USE, THE SITE OR THE CONTENT.

11.2 TO THE FULLEST EXTENT PERMITTED BY LAW, ARRHUB'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE USE OF THE SITE, OTHER THAN UNDER A SUBSCRIPTION, IS LIMITED TO ONE HUNDRED CANADIAN DOLLARS (CA$100). CLAIMS RELATING TO A SUBSCRIPTION ARE GOVERNED BY THE SUBSCRIBER TERMS.

11.3 NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW, INCLUDING LIABILITY FOR BODILY OR MORAL INJURY CAUSED TO ANOTHER, OR FOR MATERIAL INJURY CAUSED THROUGH AN INTENTIONAL OR GROSS FAULT, OR AFFECTS THE RIGHTS OF A CONSUMER UNDER THE CONSUMER PROTECTION ACT (QUEBEC) OR ANY OTHER LAW THAT PROTECTS CONSUMERS WHERE THEY LIVE.

12. Privacy and cookies

12.1 ArrHub handles personal information under its privacy policy at arrhub.com/legal/privacy, and uses cookies as described in its cookie policy at arrhub.com/legal/cookies. Those policies are not part of these terms.

12.2 The Privacy Officer of ArrHub is the person in charge of the protection of personal information, and can be reached at privacy@arrhub.com.

13. Changes to these terms

13.1 ArrHub may amend these terms by publishing a new version on the Site with its revision date. The new version applies to use of the Site after its publication. Previous versions remain available at their permanent addresses.

14. Governing law and forum

14.1 These terms are governed by the laws of Quebec and the federal laws of Canada that apply there, to the exclusion of their conflict-of-laws rules, and the courts of the judicial district of Montreal have jurisdiction, subject to any mandatory rule that allows a consumer to bring proceedings in the courts of the place where the consumer resides.

15. General

15.1 Notices to ArrHub go to alerts@arrhub.com.

15.2 These terms are the entire agreement between you and ArrHub on the use of the Site, excluding any subscription.

15.3 ArrHub may assign these terms to an affiliate or to a successor to its business.

15.4 If a provision is invalid, the rest remains in force. A failure to enforce a provision is not a waiver.
